Terms & Conditions for ‘Morning Glory’ Competition to win a 7 day holiday to Mexico
Delivered by Cafédirect, Paramount Pictures UK and NDL (“Official Rules”)

1. Cafédirect plc, which has its registered office at 24 Great King Street, Edinburgh EH3 6QN, registered as company number 141496 in Scotland (the “Promoter”), is holding a competition entitled Cafédirect Morning Glory Competition (the “Competition”) from 1st December 2010 to 30th June 2011 via the website www.cafedirect.co.uk/morningglory (the “Site”).
2. This Competition is open to residents of the UK and Ireland (excluding Northern Ireland) excluding employees of the Promoter and their immediate families, or anyone professionally connected with the promotion. Entrants must be aged 18 years and over,
3. By entering this Competition each player accepts to be bound by these Official Rules.
4. Purchase necessary. To participate in this prize draw you must purchase a promotional jar or tub of Cafédirect Freeze Dried Coffee. The winner must provide proof of purchase to claim the prize, either a till receipt or a jar of Cafédirect Freeze Dried Coffee.
5. To enter, visit the Site and enter the promotional code, found on jars of Cafédirect Freeze Dried Coffee, into the relevant section of the prize draw Site in order to have the chance to win.
6. Entries from agents, third parties, or consumer groups will not be accepted. Bulk entries from individuals will not be accepted.
7. All entries must be received by midnight on 30.06.2011 (the “Closing Date”). Entries received after the Closing Date will not be processed.
8. The winner will be selected at random from all of the entries received under independent supervision. Notice of the win will be sent to the winner within one month following the Closing Date. The winner must confirm his or her willingness to receive the prize within a period of ten days from the date of such contact, giving his or her name and postal address for delivery of the prize. Failure to confirm in that period will forfeit the prize and the Promoter will be entitled to pick another winner. The Promoter may cancel the winning of a prize in its sole discretion and without prior notice if it does not receive confirmation from the winner of willingness to receive the prize or if the shipping of the prize to the address stated by the winner is unsuccessful, and the Promoter fails to obtain the necessary information to deliver the prize successfully following reasonable efforts. In this case the Promoter will consider itself obliged to cancel the prize, without the person concerned becoming entitled to any compensation as a result.
9. The prize will be delivered once the winner has responded to confirmation of their win and a mutually agreeable date has been agreed.
10. The prize includes: (a) return flights for two people to Acapulco; (b) return transfers from the airport to the hotel; (c) 7 nights’ accommodation at the Avalon Excalibur Hotel; (d) breakfast, lunch and dinner for the duration of your stay; and (e) travel insurance (subject to normal terms of acceptance).
11. Travel is subject to availability at the discretion of the organizer “NDL”. Flights must include a Saturday night stay in your destination. Departure airport used will be dependent on the direct availability from the winners nearest international airport. The Hotel is classed as a 4 Star and is based on two adults sharing a twin or double room (winner’s choice) with en-suite bathroom on an all inclusive basis.
12. Flights cannot be taken during bank holidays, Easter, Christmas and New Year and are subject to availability at the time of booking. All those travelling must have valid passports and visas if applicable. All winners must have a full passport valid for 6 months or more from date of travel with two clear pages, and obtain any further documents required for travel. (Please note, the promoter cannot be held responsible for the failure to obtain such documents). A credit card will be required at hotel check in to act as guarantee for incidentals, room service etc. If the winner’s guest is under 18, they will require written parental/guardian consent. The winner and guest must comply with the terms and limitations of the airline and other transportation and venues involved in the Competition or prize. In particular, they must comply with all health and safety guidelines and instructions and all applicable legal and regulatory requirements. Passport control and in-country authorities will reserve the right to refuse entry. If the winner and/or guest are refused passage and or entry/exit to or from the country being visited, any additional costs incurred will be your sole responsibility. For the avoidance of doubt, the prize excludes all other costs including but not limited to any additional accommodation, travel/transportation costs including but not limited to car hire, UK transfers, ground transportation, parking costs, any inoculation and/or vaccination costs, hotel supplementary charges, excursions, water sports, spa treatments, telephone calls, room service, mini-bar goods, alcohol, programmes, souvenirs, incidental costs, unless otherwise stated.
13. HOW TO ENTER: Entries should be made in accordance with the instructions given in the promotion for the Competition via the Site.
14. By entering the Competition players confirm that all information given is complete, accurate and not misleading. The Promoter reserves the right, in its sole discretion, to disqualify any entry at any time in the event it is determined that the player has not complied with these Official Rules or has acted in an unsportsmanlike or disruptive manner. The Promoter is not responsible for misdirected, incomplete, lost, late, illegible, undeliverable entries, technical, hardware, or software failures of any kind, lost or unavailable network connections, failed, incomplete, garbled or delayed computer transmissions or other errors or problems which may limit or affect a player’s ability to participate in the Competition. The Promoter is not responsible for other errors or difficulties of any kind, whether human, mechanical, electronic, computer, network, typographical, printing or otherwise, relating to or in connection with the Competition, including without limitation, errors or difficulties which may occur in connection with the administration of the Competition, the processing of entries, the announcement of the prize or in any Competition-related materials. The Promoter does not guarantee that the Site and/or Competition will not contain IT faults, or that faults identified will be remedied; nor can it guarantee that the Site and/or sites to which the Site links do not contain viruses or other components which may cause damage to players’ computer equipment and/or data. In the event of sabotage, acts of God, terrorism or threats thereof, computer virus or other events or causes beyond the Promoter’s control, which corrupt the integrity, administration, security or proper operation of the Competition, the Promoter reserves the right, in its sole discretion, to modify, cancel or suspend the Competition (or a portion thereof). In the event of cancellation, the Promoter reserves the right to judge all eligible, non-suspect entries received prior to the event requiring such cancellation. False or deceptive entries or acts will render the player ineligible.
15. All prize details not specified herein are at the sole discretion of the Promoter. The Promoter reserves the right to substitute any prize (or portion thereof) with one of comparable or greater value, in its sole discretion. Prizes are subject to the terms and conditions of the applicable manufacturer, supplier and/or operator. Prizes must be accepted “as is” or declined. Prizes may not be transferred or exchanged for another article or cash value.
16. GENERAL RULES AND REGULATIONS: By entering this Competition and/or accepting a prize, each entrant grants the Promoter and its agents and employees the right, unless prohibited by law, to use his/her name, town, voice, performance, picture and likeness without compensation, notification or approval, for the purpose of advertising, promotion and other purposes, in any manner or medium, now or hereafter known, throughout the universe in perpetuity. Any such information will only be used in accordance with the Promoter’s Privacy Policy.
17. The Promoter expressly disclaims any responsibility for any and all claims, actions, demands and/or liability for injury, damage or loss whatsoever relating to or arising in connection with participation in this Competition (regardless of the cause of such injury, damage or loss), the Promoter’s use of any footage and/or the delivery and/or subsequent use or misuse of any of the prize awarded (including without limitation, any travel and activity related thereto). For the avoidance of doubt the Promoter does not exclude its liability for death or personal injury caused by its own negligence. In entering into this Competition, players do so at their own risk. The Promoter, its agents and employees will not be liable for any loss or damage to any property or for death or personal injury save where such death or personal injury is caused by the negligence of the Promoter, its agents or employees.
18. Any dispute or complaint concerning this Competition should be addressed to Cafédirect plc, Head Office, Unit F, Zetland House 5-25 Scrutton Street, London, EC2A 4HJ and must be so submitted within 90 days following the Closing Date of the Competition. The Promoter reserves the right to shorten, defer, alter or cancel this Competition (including without limitation the prizes offered) if it considers in its sole discretion that circumstances demand it; it cannot be held liable for this on any grounds whatsoever.
19. A hard copy of these Official Rules can be obtained by sending a stamped, self-addressed envelope to the following address by the Closing Date: Cafédirect plc, Head Office, Unit F, 5-25 Scrutton Street, London, EC2A 4HJ. A hard copy of the winners’ names can be obtained by sending a stamped, self-addressed envelope to this address on or after the Closing Date.
20. These Official Rules are subject to the laws of England and Wales. Any dispute relating to their interpretation or execution that cannot be settled amicably must be brought before the competent English courts.
21. Information obtained through this Competition shall be used in accordance with Cafédirect’s Privacy Policy which can be found at http://www.cafedirect.co.uk/privacy/.
